Terms of use

Last updated:

  1. 01Purpose

These terms of use govern the use of L’Ostéopathe, online practice management software for osteopaths, published by Jean-Vincent Quilichini, sole trader (see the legal notice). They apply to anyone who creates an account or joins a practice, and are accepted when the account is created. The French version prevails.

  2. 02Applicable documents

Also applicable: the privacy policy; the data processing agreement, which governs the processing of your patients’ data; and, for paid plans, the terms of sale (both in French, linked from this page). L’Ostéopathe is intended for professionals, for their practice.

  3. 03Access to the service

Signing up creates an account and a practice workspace. The Free plan has no end date and needs no payment method; the Solo and Practice plans are described on the Pricing page. The workspace owner invites the other members and gives them a role: they are responsible for the access they grant.

  4. 04Your account and its security

You provide accurate information and keep your password confidential. Turn on two-factor authentication; a practice owner may require it from every member. Tell us at once about any access you did not authorise, at contact@losteopathe.com.

  5. 05Signing in with a third-party account

You can sign in with an Apple, Google or Facebook account. You remain responsible for that account’s security, as for your L’Ostéopathe password. Two-factor authentication remains available and also applies to this sign-in; a practice owner may require it from every member. You can unlink that account at any time in Settings › Account security, as long as another sign-in method stays active.

  6. 06Health data and hosting

Real patient data may only be hosted by a host certified for health-data hosting (HDS), in the European Union. The current hosting of L’Ostéopathe is not HDS-certified: as long as that is the case, do not enter any real patient data in L’Ostéopathe.

  7. 07Data and processing

For your patients’ data, you are the controller; L’Ostéopathe acts as processor, on your behalf and under your instructions (GDPR, art. 28), under the terms of the data processing agreement. The providers of L’Ostéopathe are listed on the subprocessors page (both in French).

  8. 08Messages sent to patients

Depending on your settings, L’Ostéopathe sends your patients emails in your practice’s name: confirmation of an online booking, reminders and confirmation of a change or cancellation the patient makes from the link received by email, which attach the appointment’s calendar invitation (.ics file), except for an appointment in a recurring series or over a whole day; slots offered to the waiting list. The documents you send by email (fee notes, written prior information, letters) go as attachments. No text message (SMS) is sent. You inform your patients of these emails.

  9. 09Subscription and cancellation

Paid plans have no commitment. Monthly plans can be cancelled at any time, effective at the end of the current month; the yearly plan can be cancelled at any time, effective at the end of the 12-month period. After cancellation, the practice returns to the Free plan, with no data deleted. Details are in the terms of sale (in French).

  10. 10Your data stays yours

The data you enter belongs to you. The full export (CSV, JSON and documents) is available at any time, on every plan. L’Ostéopathe only uses it to provide the service: no advertising, no resale, no AI model training.

  11. 11Use of the service

You use L’Ostéopathe for your professional practice, in compliance with the law and professional secrecy. Attempting to access another practice’s data, disrupting the service or copying its content is prohibited. In case of a serious breach, the publisher may suspend the access concerned after warning you, except in a security emergency; it then lets you export your data.

  12. 12Responsibilities

The L’Ostéopathe software is a management tool. It makes no diagnosis and does not replace the practitioner’s clinical judgement. You remain responsible for the content of your records and fee notes, and for informing your patients. Drafts prepared by Theo must be checked before any use.

  13. 13Availability

The publisher makes its best efforts to keep the service available, without being able to guarantee it at all times: maintenance, an incident or a provider outage may interrupt it. Scheduled interruptions are announced when possible.

  14. 14Changes to these terms

The publisher may change the service and these terms. A significant change to the terms of use is announced by email to account holders before it takes effect; if you refuse it, you can close your account after exporting your data.

  15. 15Closing your account

You can close your account at any time: the steps are on the data deletion page (in French, linked from this page).

  16. 16Governing law and contact

These terms are governed by French law. In case of difficulty, first write to contact@losteopathe.com to seek an amicable solution; failing that, the dispute is brought before the competent court under the ordinary rules.
